1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the Bayora website, your Bayora account, our personalised book recommendation services, Reading Boxes, and related products and services.
By creating an account, placing an order, or otherwise using Bayora, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our services.
2. Eligibility and Accounts
You must be at least 18 years old to create a Bayora account or use Bayora's personalised services.
A Bayora account is currently required to purchase a Reading Box because your account and reading profile are used to personalise the books selected for you.
You are responsible for providing accurate and current information and for maintaining the security of your account. You should promptly update information that changes.
You are responsible for activity performed through your account except where otherwise provided by applicable law.
3. The Bayora Reading Box
The Bayora Reading Box is a personalised book-discovery service in which books are selected around your reading profile.
Your reading profile may take into account information such as your stated reading preferences, reading library, ratings, feedback, books you enjoyed or disliked, and books you left unfinished.
A Reading Box currently contains two books. We may introduce different box sizes or purchasing options in the future.
The titles selected for your Reading Box remain hidden before delivery as part of the Bayora experience. You will therefore not normally know which specific titles have been selected before your box arrives.
4. Book Recommendations
Bayora uses the information available in your reading profile to identify books that may suit your individual reading taste.
Reading is subjective. While our recommendations are designed around the information you provide, we cannot guarantee that you will enjoy every book selected for you.
Recommendations and final selections may also be affected by factors such as book availability, inventory and suitability.
Once books have been selected for an order, you cannot request particular titles to be revealed, removed or exchanged before dispatch merely on the basis of preference. Keeping the selected titles hidden is part of the Reading Box service.
5. Content Preferences and Warnings
Where Bayora allows you to provide content preferences, sensitivities or topics you would prefer to avoid, we may use that information when generating recommendations.
However, books can contain complex or unexpected subject matter, and information available about a book may not identify every potentially sensitive theme, scene or topic.
Unless expressly stated otherwise, Bayora cannot guarantee that a selected book will be completely free from every topic, theme or type of content that you may personally find sensitive or unsuitable.
6. Book Condition
Books supplied through Bayora are intended to be new or in new-like condition unless clearly stated otherwise before purchase.
Minor variations associated with printing, publishing, packaging or transit that do not materially affect the condition or usability of a book may occur.
7. Prices, Orders and Payments
Prices displayed for a Reading Box include applicable taxes and standard delivery charges within India unless we clearly state otherwise before purchase.
The total amount payable will be shown to you before you complete your order.
Payments are processed using Razorpay. You agree to provide accurate information required to complete your payment and order.
An order is not confirmed until the required payment has been successfully completed and the order has been accepted by Bayora.
We may reject or cancel an order where reasonably necessary, including because of inventory or availability issues, incorrect pricing, suspected fraud, payment problems, or circumstances that prevent us from fulfilling the order.
If Bayora cancels an order after successfully receiving payment, we will arrange an appropriate refund in accordance with applicable law and our payment-processing procedures.
8. Order Cancellations
You may abandon or cancel the checkout process before completing payment.
Once payment has been completed, an order cannot currently be cancelled automatically through your account.
If you need to request cancellation after payment, please contact us through our Contact page. Cancellation requests will be reviewed on a case-by-case basis and cancellation is not guaranteed, particularly once an order has entered fulfilment or has been dispatched.
Nothing in this section limits any cancellation or refund right that cannot lawfully be excluded.
9. Shipping and Delivery
Bayora currently accepts and delivers Reading Box orders within India only.
Standard delivery charges are included in the displayed Reading Box price unless clearly stated otherwise before purchase.
Any delivery date or timeframe shown to you is an estimate unless we expressly state otherwise. Delivery may be affected by courier operations, your location, weather, holidays, availability and other circumstances outside our reasonable control.
You are responsible for providing complete and accurate delivery and contact information so that your order can be delivered successfully.
10. Damaged or Defective Books
If a book arrives materially damaged or defective, please report the issue to us through our Contact page as soon as possible and preferably within 48 hours of receiving the order.
Please provide your order number, date of receipt, name, email address and contact details, together with a description of the problem.
We may ask you to provide photographs of the book, packaging or damage where reasonably necessary to assess the request.
Eligible cases will be reviewed individually. Depending on the circumstances, availability and applicable law, we may offer a replacement, refund or another appropriate resolution.
Where we require an eligible damaged or defective item to be returned, Bayora will arrange or bear the reasonable cost of the required return shipping.
The 48-hour reporting period is intended to help us investigate transit damage promptly. It does not limit any consumer right or remedy that cannot be excluded or restricted under applicable law.
11. Returns for Reading Preference
Because a Reading Box is selected around your reading profile and the titles are intentionally kept hidden until delivery, simply not enjoying a selected book does not by itself mean that the book is damaged, defective or incorrectly supplied.
Bayora does not currently offer a general return or refund solely because a selected book does not match your personal taste, except where required by applicable law.
We may introduce additional return, exchange or store-credit programmes in the future. Any such programme will be governed by the terms communicated when it is introduced.
12. Acceptable Use
You agree not to:
- Use Bayora for unlawful or fraudulent purposes.
- Attempt to gain unauthorised access to accounts, systems or data.
- Interfere with the security, integrity or operation of our services.
- Use automated systems to scrape, extract or access Bayora where we have not authorised such activity.
- Upload or submit malicious code or material intended to damage, disrupt or compromise the service.
- Misrepresent your identity or impersonate another person.
13. Intellectual Property
Bayora's website, branding, original written content, visual design, software and other original materials are owned by or licensed to us and may be protected by applicable intellectual-property laws.
Books, book covers, author names, publisher materials and other third-party intellectual property remain the property of their respective rights holders.
These Terms do not transfer ownership of Bayora's or any third party's intellectual property to you.
14. Content You Provide
You may provide ratings, feedback, reviews, reading preferences and other information through Bayora. You are responsible for information or content you submit.
You must not submit material that is unlawful, infringes the rights of another person, contains malicious material, or is otherwise intended to misuse or disrupt the service.
Information you provide may be processed as necessary to operate and improve the relevant Bayora features, including your reading profile and recommendations, as described in our Privacy Policy.
15. Third-Party Services
Bayora relies on third-party providers for parts of the service, including authentication, database infrastructure, website hosting, payment processing, email communications and delivery.
Third-party services may be subject to their own terms and policies. Bayora is not responsible for failures of third-party services to the extent those matters are outside our reasonable control, subject always to rights and obligations that cannot be excluded under applicable law.
16. Service Availability
We aim to keep Bayora available and reliable, but we do not guarantee that the website or every feature will always be available, uninterrupted or error-free.
We may modify, maintain, suspend or discontinue features where reasonably necessary. Where appropriate, we may provide notice of material changes affecting existing users or orders.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Bayora and its digital services are provided on an "as is" and "as available" basis except for warranties, representations or commitments expressly made by us.
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, consumer right or remedy that cannot lawfully be excluded, restricted or modified.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Bayora will not be liable for indirect, incidental, special or consequential losses arising from use of the service where such liability may lawfully be limited.
Nothing in these Terms limits or excludes liability, rights or remedies where doing so would be prohibited by applicable law, including applicable consumer-protection law.
19. Suspension and Termination
You may stop using Bayora at any time and may request deletion of your account in accordance with our Privacy Policy.
We may restrict, suspend or terminate access where reasonably necessary, including in cases of serious or repeated violations of these Terms, fraud, security threats, misuse or unlawful activity.
Termination of an account does not automatically cancel, refund or otherwise alter an order that has already been placed, except where required by applicable law or expressly agreed by us.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to Bayora, our services, our policies or applicable legal requirements.
When we make changes, we will update the "Last updated" date at the top of this page. Where required by applicable law, we may provide additional notice before material changes take effect.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to applicable consumer-protection law and any jurisdiction that cannot lawfully be excluded, disputes relating to these Terms or the Bayora services will be subject to the jurisdiction of the competent courts in Ghaziabad, Uttar Pradesh, India.
Nothing in this section limits any right you may have to bring a consumer complaint or proceeding before a forum having jurisdiction under applicable law.
